These Terms of Service (“Terms”) govern your use of resourcera.com and all content, reports, tools and services offered on it (the “Service”). The Service is operated by Resourcera Data Lab Pvt. Ltd. (“Resourcera”, “we”, “us” or “our”). By using the Service or buying a Report, you agree to these Terms. If you do not agree, please do not use the Service.
1. Definitions
- Account means the account you create to access purchased Reports and related features.
- Content means the articles, statistics, charts, visualizations, tools, datasets and other material published on the Service.
- Customisation Hours means the analyst time included with a License for tailoring a Report to your requirements.
- License means the right to use a Report granted to you under Section 5.
- Report means any paid market research report, including its workbooks, source data and related files.
- You means the individual using the Service, or the company or organization on whose behalf that individual is using it.
2. Eligibility
You must be at least 18 years old to use the Service. If you use the Service or buy a Report on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
3. Accounts
Some features, including access to purchased Reports, require an Account. You must give accurate information, keep your login details confidential and tell us promptly at [email protected] if you suspect unauthorized use. You are responsible for all activity under your Account. We may suspend or close an Account that breaches these Terms.
4. Free Content
Our articles, statistics and charts are free to read. You may cite them with a visible credit and a link to the source page, as set out in our Data Usage, Attribution & Licensing Policy. Apart from that, you may not reproduce, republish or distribute Content without our prior written permission.
5. Purchases and Licenses
Reports are licensed, not sold. When you pay for a Report, we grant you a non-exclusive, non-transferable License to use it for your internal business purposes under the tier you bought:
- Individual License: one named user.
- Team License: up to five named users within one organization.
- Enterprise License: unlimited users within one organization and its controlled subsidiaries.
You may quote limited excerpts in internal and client presentations with the credit “Source: Resourcera”. You may not resell, sublicense, publicly post or share a Report, its workbooks or its source data with anyone outside the licensed users, or use them to build a competing product or dataset.
6. Customisation and Analyst Support
Customisation Hours included with a License must be requested within 90 days of purchase. We agree the scope of each customisation with you in writing before starting work. Unused hours expire at the end of that period and have no cash value. Analyst support covers questions about the Report’s findings and methodology.
7. Payments and Taxes
Prices are shown in US dollars ($$$). Payments are processed by Stripe, and we do not store your full card details. Prices exclude applicable taxes such as GST or VAT, which are added at checkout where required. Access to a Report starts once payment has cleared.
8. No Refunds
Because Reports are digital products delivered immediately, all sales are final and we do not issue refunds once a Report has been delivered or made available in your Account.
If a Report file is corrupted, incomplete or materially different from its published description, email [email protected] within 7 days of purchase and we will correct or replace it.
If you are a consumer in the European Union or United Kingdom, you agree at checkout that delivery starts immediately and acknowledge that you therefore lose your statutory right to withdraw from the purchase. Nothing in this section limits any right that cannot be excluded by law.
9. Intellectual Property
The Service, the Content and all Reports, including their text, data compilations, visualizations, design and trademarks, are owned by Resourcera or its licensors and are protected by copyright and other intellectual property laws. Except for the rights expressly granted in these Terms, no rights are transferred to you.
10. Automated Access and AI Training
You may not scrape, crawl, harvest or bulk-download the Service, or use any Content or Report to train, fine-tune or evaluate machine-learning or artificial intelligence models, without our prior written permission.
11. Affiliate Links and Third-Party Websites
Some pages contain affiliate links, which may earn us a commission at no extra cost to you. Our Affiliate Disclosure explains how this works. The Service may link to websites and services we do not control. We are not responsible for their content, products or privacy practices, and your use of them is at your own risk.
12. Data Accuracy Disclaimer
We research and verify the information we publish carefully, drawing on the sources described in Our Data Sources and our Editorial Standards. Statistics, estimates and forecasts can still contain errors or become outdated, and we make no guarantee that they are complete, accurate or current. You should independently verify any information before relying on it for business, financial or legal decisions.
13. “AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure or free of errors or harmful components.
14. Limitation of Liability
To the fullest extent permitted by law, Resourcera will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunities, arising from your use of the Service or any Report.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or USD 100 if you have not purchased anything. Some jurisdictions do not allow these limitations, so they may not all apply to you.
15. Termination
We may suspend or end your access to the Service, including your Account, if you breach these Terms. On termination, your right to use the Service ends. Sections that by their nature should continue, including Intellectual Property, disclaimers, Limitation of Liability and Governing Law, survive termination.
16. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. If you have a concern or dispute, you agree to first try to resolve it informally by emailing [email protected]. If it is not resolved within 30 days, the courts at Nashik, Maharashtra, India will have exclusive jurisdiction, except where the law of your country of residence gives you a right to bring proceedings there that cannot be waived.
17. European Union and United Kingdom Users
If you are a consumer in the European Union or United Kingdom, you benefit from any mandatory provisions of the law of the country in which you live.
18. United States Legal Compliance
You confirm that you are not located in a country subject to a United States government embargo or designated as a “terrorist supporting” country, and that you are not on any United States government list of prohibited or restricted parties.
19. Severability and Waiver
If any provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will stay in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
20. Translation
If these Terms are translated, the English version prevails in the event of any conflict.
21. Changes to These Terms
We may update these Terms from time to time. For material changes, we will give at least 30 days’ notice by posting on this page or emailing Account holders before the changes take effect. Continuing to use the Service after that date means you accept the updated Terms.
